The rules for using lit-apparel.com: your account, what is and is not allowed, who owns what, what you share with us, Lit Crew guidance, and the limits of our responsibility for the site.
lit-apparel.com is run by Lit Apparel LLC, 937 Holmes Rd, Ypsilanti, MI 48198 ("Lit Apparel", "we", "us"). These terms apply whenever you visit or use the site, its accounts and its community features. By using the site you agree to them; if you do not agree, please do not use it.
Buying from us is also covered by our terms of sale, how we handle your information by our privacy policy, and anything you contribute by our community rules. Where these terms and the terms of sale disagree about an order, the terms of sale apply.
You must be at least 13 to create an account, and old enough to form a binding contract where you live (or have a parent or guardian’s permission) to buy or subscribe.
You may not use the site if we have closed your account for breaking these terms, or where the law does not allow it.
Please use the site the way it is meant to be used. You may not:
Everything on the site, including designs, graphics, photographs, video, text, software and the Lit Apparel name, logo and marks, belongs to us or to the people who license it to us, and is protected by copyright and trademark law.
You may view and share pages for your own personal, non-commercial use. You may not copy, reproduce, sell or use our content or marks for any other purpose without our written permission.
Reviews, shared posts, Wall of Passion entries, sightings, photos, forum posts and messages must be yours to share and must follow our community rules.
You keep ownership of what you submit. By submitting it, you give us a non-exclusive, royalty-free licence to show, adapt (for example, crop or resize) and share it on the site and in our channels, credited as you asked, until you ask us to take it down. Ideas and feedback you send us can be used without any obligation to you.
We review community contributions before they appear and may decline, edit for length or remove anything at our discretion.
Training programmes, exercise videos, recipes, supplement guides, forum answers and other Lit Crew content are general information for healthy adults. They are not medical, nutritional or professional advice, and they do not create a coach–client or medical relationship.
Check with a doctor or qualified professional before starting a new training or nutrition programme, especially if you are pregnant, injured or have a health condition. Train within your limits, use equipment safely, and stop if something hurts. You take part at your own risk.
Paid Lit Crew memberships are also covered by our terms of sale.
The site links to and uses services run by others, such as Stripe for payments and Google for analytics if you allow it. Their own terms and privacy policies apply to them, and we are not responsible for their content or practices.
We work to keep the site available and accurate, but we may change, suspend or withdraw any part of it, including features, products and content, at any time. Product details, colours and availability can change, and occasional errors happen; we correct them when we find them.
The site is provided "as is" and "as available". To the extent the law allows, we do not promise that it will always be uninterrupted, error-free or free of harmful components.
We are not responsible for loss that was not a foreseeable result of our breaking these terms, for business losses, or for problems caused by events outside our reasonable control. Nothing in these terms limits liability where the law does not allow it to be limited, including for death or personal injury caused by negligence, or for fraud, and nothing affects your legal rights as a consumer.
To the extent the law allows, our total liability to you for anything arising from your use of the site is limited to the greater of $100 or the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental or consequential losses. If you misuse the site or post content that breaks these terms or the law, you agree to cover the reasonable costs and claims that result for us. None of this affects any right you have as a consumer that cannot be limited.
We may suspend or close an account, or limit access to the site, if these terms or the community rules are broken seriously or repeatedly, to protect other people, or where the law requires. Where it is fair to do so we will tell you why. Orders already paid for are handled under the terms of sale.
If something goes wrong, contact us first and we will try to put it right. These terms are governed by the laws of the State of Michigan, unless the law where you live gives you rights that cannot be taken away.
ARBITRATION. Except for claims that qualify for small-claims court, and except that either of us may go to court to stop infringement or misuse of intellectual property, any dispute between you and Lit Apparel that we cannot resolve informally within 60 days of your written notice will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may take place by video or phone, or in Washtenaw County, Michigan or the county where you live, and we will pay the filing and arbitrator fees the AAA rules assign to the business. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding, and an arbitrator may not combine more than one person’s claims. You may opt out of this arbitration agreement by emailing hello@lit-apparel.com within 30 days of first accepting these terms, with your name and a clear statement that you opt out. If this arbitration agreement does not apply or is found unenforceable, disputes go to the state or federal courts in Washtenaw County, Michigan.
We may update these terms from time to time. We will change the date at the top of this page, and tell you by email or on the site before any significant change takes effect. Using the site after a change means you accept the updated terms.
Questions about these terms: reach us through our contact page or by email at hello@lit-apparel.com.
