Help / Terms of sale
The agreement when you buy from Lit Apparel: orders and pricing, payment, delivery, returns, Lit Crew memberships, points, gift cards, and the use of this site.
These terms apply when you buy from lit-apparel.com, which is run by Lit Apparel LLC, 937 Holmes Rd, Ypsilanti, MI 48198. By placing an order you agree to them. Please read them with our shipping and returns page and our privacy policy, which form part of them. Using the site itself, including your account, is covered by our Terms & Conditions.
Nothing in these terms takes away rights you have by law as a consumer.
Your order is an offer to buy. We accept it when we email to confirm the order; until then we may decline it, for example if an item has sold out, a price was wrong, or the order looks fraudulent. If we cannot fulfil an order we have charged for, we refund you in full.
Drops are limited runs. We may limit how many of a piece one customer can buy, so that a run reaches people rather than resellers, and we may cancel orders that get around those limits.
Prices are in US dollars. Shipping is shown at checkout before you pay, and sales tax is added at checkout where it applies. We take payment when you place the order, through Stripe.
If we show a price that is clearly an error, we will tell you and give you the choice of paying the correct price or cancelling.
Colours on screen vary by display; product photos are as accurate as we can make them.
Some drops are sold as preorders, paid now and shipped when the run is made. The product page gives the expected dispatch window. If it moves by more than 30 days, we will tell you and you may cancel for a full refund.
Delivery regions, costs, dispatch cut-offs and timings are on our shipping and returns page, and the cost of your order is confirmed at checkout. Delivery dates are estimates, not guarantees.
Ownership and risk pass to you on delivery. If a parcel is lost or arrives damaged, contact us and we will put it right. International orders may be charged import duties and taxes by the destination country, which are the recipient’s to pay unless checkout says otherwise.
You can return or exchange unworn, unwashed pieces with tags attached within 30 days of delivery, as set out on our shipping and returns page, which also lists what cannot be returned and what is final sale.
If something is faulty or not as described, you are entitled to a repair, replacement or refund under the law, whatever our returns window says.
Lit Crew is a paid membership that renews automatically each month at the price shown when you join, until you cancel. Any free trial is shown before you join, and you will be charged when it ends unless you cancel before then.
You can cancel at any time from your account; you keep access until the end of the period you have paid for. We do not refund partly used periods.
We will tell you before a price change takes effect, and you can cancel before it does. Members agree to the Lit Crew code of conduct; we may suspend or end a membership for serious or repeated breaches.
Training programmes, recipes and forum answers are general guidance, not medical advice. Check with a doctor before starting a new training or nutrition programme, especially if you have an injury or a health condition, and train within your limits.
Points are a reward, not money. They have no cash value, cannot be sold or transferred, and are worth $0.25 each only when redeemed against a drop preorder, in steps the redeem control shows (at least 40 points).
Drop Points are earned at 10 points for every whole $100 you prepay on a drop preorder, and clear once that drop ships. If an order is cancelled or refunded, the points it earned are removed.
Field Points are earned when a person at Lit Apparel confirms a sighting you logged while signed in: 25 points, or 50 when the wearer confirms it with you. A garment earns you points once, and up to 5 sightings a week earn. Points awarded for a sighting that is later withdrawn are removed.
We may change or end the points programme with 30 days notice; points you hold when it ends can be redeemed during that notice. We may remove points obtained by fraud or by breaking the community rules.
Gift cards are paid in US dollars, can be spent on lit-apparel.com, and do not expire. There are no fees for buying, holding or using one. They cannot be exchanged for cash except where the law requires. Keep the code safe: we cannot replace a card that someone else has spent. We refund a gift card purchase only if the card is unspent and you ask within 30 days of buying it; a card that has been used, even in part, is not refundable. To prevent fraud, one buyer can buy up to 5 cards and $500 in gift cards a day, and we may review or decline a purchase over $300.
LIT Drop Club is a monthly tee subscription. When you join you are charged the monthly price shown, plus applicable tax, and then automatically on the same day each month until you cancel. Shipping to the contiguous United States is included. Each paid month is one LIT tee in your size; the design is chosen by us and changes each month.
Skipping a month: from your account, before your next billing date. That month is not charged and nothing ships, and your billing day stays the same.
Cancelling: from your account, at any time. Cancelling stops future charges; a month you have already paid for still ships, and is not refunded.
Your size and address can be changed for future months; a month already paid ships in the size and to the address it was paid with. If a payment fails, nothing ships for that month until it is paid.
While the club is a pilot, membership is limited to 50 members; when it is full, new sign-ups join a waitlist. Joining the waitlist is free and commits you to nothing.
Exchanges: one exchange per shipped month, requested from your account within 14 days of delivery, for an unworn tee with its tags on. If you want a different size from the one you chose, you pay the return postage; if we sent the wrong item or it is faulty, we send a prepaid label. Drop Club tees are exchanged, not refunded.
Your account, what you may and may not do on the site, our content and what you submit to us are covered by our Terms & Conditions, which apply alongside these terms whenever you shop.
We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, for business losses, or for delays caused by events outside our reasonable control.
Nothing in these terms limits liability where the law does not allow it to be limited, including for death or personal injury caused by negligence, or for fraud.
To the extent the law allows, our total liability to you for any order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential losses. This does not affect any right you have as a consumer that cannot be limited.
If something goes wrong, contact us first and we will try to resolve it quickly. These terms are governed by the laws of the State of Michigan, unless the law where you live gives you rights that cannot be taken away.
ARBITRATION. Except for claims that qualify for small-claims court, and except that either of us may go to court to stop infringement or misuse of intellectual property, any dispute between you and Lit Apparel that we cannot resolve informally within 60 days of your written notice will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may take place by video or phone, or in Washtenaw County, Michigan or the county where you live, and we will pay the filing and arbitrator fees the AAA rules assign to the business. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding, and an arbitrator may not combine more than one person’s claims. You may opt out of this arbitration agreement by emailing hello@lit-apparel.com within 30 days of first accepting these terms, with your name and a clear statement that you opt out. If this arbitration agreement does not apply or is found unenforceable, disputes go to the state or federal courts in Washtenaw County, Michigan.
We may update these terms. The version that applies to an order is the one on the site when you placed it.
